Hi Addicts.

I have absolutely no idea how military courts work.
I was watching "Platoon" today, almost near the part where berringer shoots one of his own men.
It got me to thinkin',If a military man kills someone in a bar when he(for sake of an argument) is on a weekend pass, who does he have to answer to?The civilian court or the military court?

God Bless,
Kaz

In regards to your thought. Murder is murder.
But that's where this gets tricky. Because battlefield or not, to kill another is murder. To wound or cause grievous harm is attempted murder. It's all tricky to understand, which is why so many think war is a useless and pitiful act. yet, it happens. So, bearing that in mind, yes, is a Soldier in a bar kills another, soldier or otherwise, he can be court-marshaled by a civilian court, or by the offices that govern the military section in which the offending soldier is apart of. Which can in turn lead to dishonorable discharge, and imprisonment.

A crime is a crime, no matter who you are.

If an enlisted soldier breaks the law, he can be arrested by local law enforcement, but turned over to military courts to be judged.

Hi Dart!
What if the victim is a civilian?

If an enlisted soldier breaks the law, he can be arrested by local law enforcement, but turned over to military courts to be judged.

If an enlisted soldier breaks the law OUTSIDE of a military base, he can still be arrested by local law enforcement. That is, if a soldier starts a fight with a civilian, the soldier can be arrested. However, local law enforcement would turn him over to military police as soon as possible.
